Dan McGarry got it wrong

Sovereignty is better understood by people who without their ego know that in any free country, it is the rule of state authority that makes decisions for the interest, for the welfare, for the safety, and for the wellbeing of a state.

This sovereignty at all times protects the interest of a state and it is commonly termed as a Political leadership and as the case in all free nations around the world, it comes into being through the process of an election as stipulated by the rules of democracy.

A sovereign State like Vanuatu does have the prerogative powers to decide what is best for the interest of Vanuatu and the paramount responsibility here is protecting the state and this is where Dan McGarry, Daily Post Media Director, got it all wrong.

In his own schooled state, McGarry decided to put his own job description first before the safety and well being of Vanuatu and he has indeed damaged Vanuatu in a lot of ways.

He has in all sense, risked the hospitality of the country hosting him as a resident and without any Sovereign feelings in him, he has lost respect among the leadership of the country which has accepted him to live, to be happy, to make money for himself and in a way lost respect from the country that bore him his current partner.

In a recent saga concerning 6 Chinese nationals, the state acted in the interest of the state and the actions of the state was and is in the best interest of the state, and that one responsibility, Dan McGarry with all his schooled years ignored.

McGarry should know the state has the prerogative powers to act and if any individual feel their rights are being infringed, the rule of law as directed democratically does provide a way to settle such matters.

Undermining the power of the state because of a job description is child play and the need to be heard and the want to be seen as important has made Dan McGarry stoop very low. State secret is Sovereignty as the guidelines of any leadership cannot and must not be an open book as it can leave the security of a country vulnerable.

Dan McGarry in his unintelligent mindset has decided that 6 criminals from China have a right in Vanuatu. Seriously? This man must be from Mars or plainly an idiot.

By law, once you are known as a criminal, and you are detained by the rule of law, your freedom of movement is null and void and it is up to the state to decide your fate.

The Universal Declaration of Human Rights says “In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.”

When Vanuatu detained the 6 Chinese Nationals, it also made them a state responsibility and in this situation especially when dealing with foreign nationals, it is diplomatic respect to notify their country of origin which the Vanuatu Government duly took action on.

The way Vanuatu treated the 6 Chinese Nationals does say a lot about Vanuatu as a society and this alone has gained the respects of many Governments because now they know if any of their people come to Vanuatu and have issues, Vanuatu will take good care of them and this is one diplomatic play Dan McGarry misinterpreted.

Extradition treaties do not exist in Vanuatu however the consensus in international law is that a state does not have any obligation to surrender an alleged criminal to a foreign state, because one principle of sovereignty is that every state has legal authority over the people within its borders. Now according to International Law, once the 6 nationals are known as criminals and are in Vanuatu, it becomes Vanuatu’s responsibility to decide their fate and having said that, where did the Vanuatu Government go wrong here when they did the right thing by diplomatic means?

As duly noted “one principle of sovereignty is that every state has legal authority over the people within its borders”  and with this statement, we can clearly say Dan Mcgarry should be ashamed of himself as he has now shot himself in the foot.

All other questions do not matter when it is a sovereignty issue and if McGarry does not understand this, then he is living in the wrong country.

There is a difference between rights and freedoms and McGarry also got himself confused over the two.

Vanuatu will always see China as an Allie as the Chinese were friends with Vanuatu when it fought for its freedom and were firm supporters and to see McGarry question that relationship is indeed an insult because Canada never offered Vanuatu its support during the most crucial moments in its history and because of this relationship, He, Dan McGarry is enjoying the benefits.

Governments operate within other borders once they have approvals and this is a norm around the world but maybe the tropical climate has burned too many hairs on McGarry’s head as he feels this is something new.

The bottom line is the Vanuatu Government has the prerogative power to decide given it is within its own laws and within respects of international laws and every individual within Vanuatu borders are under the authority of the Vanuatu Government and this includes Dan McGarry.

Dan McGarry in a way has tarnished the reputation of Vanuatu over an event which the Vanuatu Government displayed great diplomacy and statesmanship.
